Trivver, Inc. (“Trivver”, “we”, “us”, or “our”) operates an advertising exchange for Extended Reality (XR) environments including 3D, virtual reality, mixed reality, and augmented reality. In these environments, you can browse products through the Trivver Product Portal (“Product Portal”).The Product Portal is an extension of Trivver’s core ad exchange that on consumer action, appears over current digital ads, providing access to fully immersive interactive 3D products, detailed product information, eCommerce features, and engagements in 3D/Augmented Reality.
This Product Portal allows publishers and advertisers to personalize user engagement with their favorite brands. Users can engage with brands they want at their leisure. Also, users can join the Trivver Data Rewards Program (“Data Rewards”) that was launched in partnership with Mastercard and earn money for qualifying activities. Whether you are a user, publisher, advertiser, or website visitor, your privacy is important to us. Please read this Privacy Notice in full to understand how we collect and process your personal information.

This Privacy Notice (“Notice”) describes what information we collect; how we collect, use, share, and process this information; what rights and choices you may have with respect to your personal information; how you may contact us; and how we protect the personal information we collect about you when you interact with us in any of the following ways (collectively, the “Data Rewards Services”):

Other Ways Trivver Uses and Shares Information

In addition to the table above, we will collect and process information about you in the following situations:

  • Consent: We also collect and process information we have about you for other purposes if you consent to those uses at the time you provide your personal information.
  • Cookies and Tracking Technologies: Trivver and third parties also collect information about your online activities on our Sites to provide you with advertising about products and services tailored to your interests. We contract with third parties that collect information about your use and interactions with our Site and Services, and across third party websites and online services to provide you with tailored email marketing and online display and banner advertising to you on other website and online services. To serve this advertising, Trivver and third party advertisers use cookies, device identifiers and similar technologies to obtain information about customer interactions.   • De-identified or aggregate information: Trivver may use information we have about you to create de-identified or aggregate information that will no longer be identifiable to you, such as de-identified demographic or location information, information about devices used to access our Services, or other relevant analyses.
  • Legal, Regulatory, Safety, and Compliance: In certain situations, we may be required to use and share your information as required by law. This includes:
    • Complying with a subpoena or other legal process requests,

  • Communications Preferences: If you elect to receive periodic email communication from us (i.e., company news, product, and service information), you may choose to opt out from receiving such communications by clicking the ‘Unsubscribe’ link provided in these emails.

How We Transfer and Store Information

Trivver may transfer, process, or store your information outside of your country of residence to provide our Data Rewards Services. We use data hosting service providers in the United States to store information we have about you, and we use reasonable technical measures to secure your information. Whenever we transfer your information, we take the appropriate steps to protect it. This includes the use of standard contractual data protection clauses or other appropriate legal mechanisms to safeguard the transfer.

How Long We Retain Information

Trivver retains your information for as long as needed to fulfill legal and contractual obligations and legitimate business purposes outlined in this Notice; to support business operations; to develop Data Rewards Services; to resolve disputes; and to enforce our rights. Trivver will also retain information under a customer’s instructions and as required by law.

The criteria used to determine our retention periods include:

  • Only retaining personal information for as long as needed to fulfill our legitimate business purposes;
  • The minimum necessary retention period prescribed by applicable laws, recommended by industry standards, and stated in contracts and other legal obligations; and
  • Retention of records to fulfill a legal or regulatory obligation or investigation.

Third Party Services, Applications, and Websites

Certain third-party services, applications, or websites used to navigate to and from our Data Rewards Services have separate user terms and privacy policies that are independent of this Notice. Trivver requires third-party service providers acting on our behalf or with whom we share your information to provide appropriate security measures in accordance with industry standards and in compliance with this Notice, their privacy and security obligations, and any other appropriate confidentiality and security measures. However, we are not responsible for the privacy and data security practices of third parties outside of personal information we receive from or transfer to them. We recommend carefully reviewing the user terms and privacy statement of each third-party service, website, and/or application prior to use.

How We Protect Your Information

Trivver takes security of data seriously. We are committed to maintaining the confidentiality, integrity, and security of your personal information and take precautions to protect such information. It is our policy to use reasonable and appropriate administrative, technical, and physical safeguards to protect information we have about you from loss, theft, and unauthorized use, access, modification, or destruction. We periodically review our established policies and procedures to ensure that they are appropriate and effective at meeting our commitment to our community, our customers, and ourselves. We also require third-party service providers acting on our behalf or with whom we share your information to maintain security measures consistent applicable regulatory compliance requirements.

Notwithstanding our security safeguards, it is impossible to guarantee absolute security in all situations. If you have any questions about the security of our Data Rewards Services, please contact us as described in the “Contact Us” section. For your own online security, please do not send any other confidential personal information to us via email or through the contact form on our website.

Minimum Age Requirements to Use Our Data Rewards Services

Trivver Data Rewards Services are not directed to children under 13. To use Trivver’ Data Rewards Services, you must be old enough to consent to the processing of your Personal Information in your jurisdiction. If we learn a child under 13 has provided us with Personal Information, Trivver will take immediate steps to delete such information.

Changes to this Privacy Notice

We periodically review and update this Notice to describe new Data Rewards Services or changes to our practices. You can determine when this Notice was last revised by referring to the “Updated” date at the top of this Notice. We encourage you to review the Notice whenever you interact with us to stay informed about our privacy practices and the ways you can help protect your privacy.

If the changes we make to this Notice are significant, we will notify you by email and through a prominent notice on this website. If you do not agree with the privacy practices disclosed in the Notice, we recommend you stop using our Data Rewards Services.

Scope and Applicability

This Appendix A (“Appendix”) applies to California residents and outlines your rights and choices with respect to the processing of your personal information under the California Consumer Privacy Act (“CCPA”). This Notice does not apply to Trivver employees or job applicants. This Appendix controls to the extent it conflicts with any provision in the main body of the Privacy Notice (“Notice”). Publicly Available Information: Personal information does not include publicly available information. Your CCPA Rights

Exercising your Rights

If you wish to exercise any of the above rights, contact us at ContactUs@Trivver.com or review the “Contact Us” section in this Appendix. You may also authorize an individual to submit a verifiable consumer request relating to your personal information.

We will verify your request using your email address. If you’ve created an account with us, we will also verify your request using the information associated with your account, including billing or shipping information. Government identification may be required. We cannot respond to your request if we cannot verify your identity and/or authority to make the request on behalf of another and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.

If you wish to use an authorized agent to submit a request to opt-out on your behalf, you must provide the authorized agent written permission signed by you, the consumer. We may deny a request from an authorized agent if the agent cannot provide to Trivver your signed permission demonstrating that they have been authorized to act on your behalf.

We will fulfill your request within 30 days of receiving your request. Please note that your request may be limited in certain cases, for example if complying with your request would conflict with:

  • Federal, state, or local law;
  • Regulatory inquiries;
  • Subpoenas; or
  • Exercising or defending legal claims.

  • Marketing and advertising. Trivver and our service providers use cookies and other tracking technologies to market products or services, monitor which ads have been served to your browser, which webpages you were viewing when such ads were delivered, and provide you advertising based on your browsing activities and interests.
  • Analytics and integration. Trivver and our service providers use third party analytics and marketing integration services such as Google Analytics to track and optimize our Data Rewards Services’ performance and marketing activities.
